Privacy Policy

Privacy Policy

  1. Object of the Privacy Policy In compliance with current legislation on the protection of personal data, ikanos wishes to inform users of the policy regarding the treatment and protection of personal data of those persons who provide their personal data through the personalised use or under registration of the services of the websites or any other act that involves the communication of their personal data to ikanos. Likewise, we inform the user that this Privacy Policy contains a general description of the aspects related to the treatment of personal data that ikanos carries out as the party responsible for said treatment derived from the exploitation of the websites. This policy is completed with those informative texts and texts requesting informed consent that are incorporated into any data request form of the web sites or are included in any particular conditions for the use of certain services. It is the responsibility of the user to read, prior to communicating his/her personal data to ikanos, the aforementioned informative texts and texts requesting consent included in any form requesting data from the websites. This policy is expressly and fully accepted by the user from the moment in which, in order to use the websites or the services published therein, he/she communicates his/her personal data to ikanos, given that such communication is always voluntary. In the event that the user does not agree with this policy, he/she should not use any of the website services that require the communication of his/her personal data to ikanos. Likewise, the user is informed that this policy will be of subsidiary application of those others that, on the same matter are established with special and/or particular character and are communicated to the user, without limiting character, through the registration forms, conditions of contracting or conditions of the particular services, remaining the present policy as complementary of the previous ones in that which is not contradicted. The user is informed that any processing of personal data, will be under the scope of application of current legislation in Spain on data protection.

  3. Minors Data Minors under 18 years of age may not use the particular Services of ikanos that require registration or identification as registered users, not even with the representation of their parent, guardian or legal representative.
  4. Accuracy and veracity of Personal Data Users who access websites are not required to provide personal information to browse them, therefore, any communication of data for such purposes will be because the user has voluntarily decided a navigation or custom use of websites and / or services made available to the user through the websites. The user accepts to provide truthful, updated, complete and correct information, always and only corresponding to his/her own identity (it is forbidden to provide data from third parties) through any data collection channel published on the websites, such as registration or subscription forms, contact forms, suggestions, contracting forms and/or any other form requesting data from the websites, by sending an email to ikanos or, through a postal communication, as indicated below. The user is solely responsible for the truthfulness, accuracy, updating and correction of the data provided, ikanos being exonerated of any responsibility in this respect, the user committing to keep the personal data duly updated. The user is the only source of information on his/her personal data, and therefore ikanos requests that, in order to keep his/her data updated and updated at all times in accordance with the principles of data protection legislation, he/she informs the address indicated for the exercise of the rights indicated in this Policy of any variation thereof. In any case, when the data are collected or provided directly from the affected user, in accordance with the provisions of current legislation, the data provided by the user will be considered accurate, as long as the user does not update or rectify them in ikanos.
  5. Data of special categories ikanos neither requests nor requires through the web sites information or data of special categories of users, being understood by these, in accordance with the legislation in force, data revealing ethnic or racial origin, political opinions, religious or philosophical convictions, or trade union membership and genetic data, biometric data aimed at identifying a physical person univocally, data relating to physical or mental health, data relating to sexual life or sexual orientations of a natural person. Should ikanos at any time require this information from the user, the express consent of the user will be requested to collect and use this information, communicating to the user, previously and unequivocally, the purpose of the collection and processing of this information. Consequently, in the event that for any reason – and without having been requested by ikanos – said information is voluntarily communicated by the user to the aforementioned entity, said communication will suppose the existence of a manifestation of express consent by the user with respect to the treatment of their data by ikanos.
  6. Purposes for which the personal data are intended The user who accesses the ikanos websites and voluntarily provides personal information to browse the websites in a personalised manner or use any service that requires the communication of data is informed of the following purposes of the processing of his/her personal data that ikanos will be able to carry out.
    • Registration on the Websites When the user registers on our Websites, the personal data provided for this purpose will be processed in order to manage the registration, as well as the data generated as a consequence of the use of the services of the Websites through their user name(s) and password(s).
    • Subscription to services for sending communications and newsletters When the user registers in the services published in the ikanos websites for the subscription to the sending of communications and newsletters and/or requests such sending through any other means, such as a request to ikanos through an e-mail, we will treat the user’s personal data in order to manage the subscription to the service, as well as for the sending of the mentioned communications and newsletters. In the event that the user terminates the service, revokes his consent or opposes the receipt of such mailings, we will only retain the minimum data essential to prevent the user from sending these communications and newsletters.
    • User opinions and comments When the user registers in the services published in the ikanos websites to give their opinion on the service, we will process their personal data to manage the subscription to the service, as well as for the service to identify them as its author and, in addition, to moderate the messages and contents communicated by the user and, where appropriate, to avoid publication and/or eliminate opinions that do not comply with the conditions of use of the service.
    • Publication of contents by the user When the user registers in the services published in the ikanos websites, in order to publish contents through the services set up for this purpose, we will process his/her personal data in order to manage the subscription to the service, as well as to manage and guarantee the publication of the user’s contents and, where appropriate, to publish his/her condition as author or owner of the same. Likewise, ikanos will treat your data to verify, if necessary, your condition as holder of the intellectual property rights.
    • Online registration service in ikanos. When the user uses the online registration service at ikanos, he/she will process his/her personal data in order to attend and manage the registration in the service.
    • Information, Suggestions and Contact Service. When the user uses the services to send suggestions or contact with ikanos (through forms or e-mail), we will treat their personal data to attend and manage the answer of the suggestion or request made by the user.
  7. Processing purposes common to the collection of personal data of the user through registration and use of all services of the websites
    1. With voluntary character and legitimate base in the consent that in its case the user grants to ikanos, ticking the boxes enabled to the effect in the forms of data collection published in the web sites:
      • To send the user, by e-mail, communications about ikanos’ services related to digital competences.
    2. Based on legitimate interest: To conserve the minimum essential data of the user who objects to ikanos sending them communications, in order to be able to identify them and adopt the necessary measures to prevent these communications from being sent.
  8. Recipients of the user’s personal data Based on the processing of personal data exposed in the previous section, ikanos informs the user that it does not intend to communicate its personal data to third parties.
  9. Exercise of rights of access, rectification, erasure, opposition, limitation to processing and portability  ikanos informs the user of the possibility of exercising their rights of access, rectification, cancellation and opposition by means of a written communication to the e-mail address ikanos@euskadi.eus. To this end, the user must send the written communication indicating the request or right exercised along with a copy of your ID or valid document in law that proves your identity. As from 25 May 2018, the user may exercise, under the terms determined by the applicable regulations, the rights of access, rectification, suppression, limitation to treatment, opposition, portability and the right not to be the object of a decision based solely on automated treatment, including the preparation of profiles, by means of a written communication to the e-mail address ikanos@euskadi.eus. Likewise, the user has the right to withdraw the consent given in relation to the processing of personal data that are voluntary, without affecting the legality of the processing based on consent prior to withdrawal, by written communication to the email address ikanos@euskadi.eus accompanied by a photocopy of the national identity document. The user is informed that he/she has the right to file a complaint with a control authority, the Spanish Data Protection Agency, regarding the exercise of his/her rights.
  10. Data retention period. ikanos will keep the user’s personal data for as long as the treatment is maintained and the user does not request their deletion.
  11. Social Networks.  ikanos does not have profiles on social networks.
  12. Personal data published on the ikanos websites.  The user is informed that these data form part of one or more data processing operations under the responsibility of ikanos in which they have been incorporated with the prior informed consent of the interested parties and cannot be freely processed and reproduced by the user or other third party users -not even when reference is made to the origin thereof- unless prior authorisation and informed consent is obtained from the interested party. The personal data that ikanos may publish on its websites may consist, without limitation, of any numerical, alphabetical, graphic, photographic, acoustic or any other type of information concerning identified or identifiable physical persons, such as names, surnames, photos, images of events held by ikanos, data published by the users of the services of the ikanos websites and other information. Therefore, all personal data -including images, videos, texts, data and any other information published on our websites about identified and/or identifiable physical persons- may only be used by the user in order to participate and enjoy our websites in the manner established in this policy or, where appropriate, in the general and specific conditions governing a given service, and within the framework of current legislation, The inclusion of images or data in files or treatments and/or the creation of databases of persons and/or the sending of advertising or cession to third parties is expressly prohibited without the prior informed consent of the interested party who owns the information and data. Ikanos is not responsible for the uses that the user or other third party users of our websites make in contravention of what is established in these conditions and others that regulate them. At no time should the user consider that the ikanos websites are a source accessible to the public from which a free disposition can be made of the personal data, information and contents published through them.
  13. Recommendations to users ikanos recommends the user to use the latest versions of the computer programs for surfing the Internet given the incorporation in these of greater security measures. Likewise, ikanos recommends users to use the security mechanisms available to them (secure web servers, cryptography, digital signature, firewall, etc.) to protect the confidentiality and integrity of their data to the extent necessary, given that there are risks of impersonation or violation of communication. ikanos reminds users that the Internet is not totally secure. However, different means exist and are being developed that allow you to improve the protection of your data. Therefore, use any means at your disposal to protect your data and communications, such as legally available encryption for confidential e-mail and access codes to your own personal computer. ikanos warns users that whenever they provide personal information over the Internet by means of e-mail, newsgroups, discussion forums, etc., bear in mind that such information may be collected and processed for purposes not desired by users, and therefore ikanos recommends that users inform themselves about the privacy and confidentiality policies of the online sites they visit. Users are also warned to bear in mind that, unless they use encryption mechanisms, e-mail on the Internet is not secure. Mail messages and discussion forums may be subject to forgery and impersonation, which should be taken into account whenever used. If you do not want to publish your e-mail address, configure your browser so that it does not leave your e-mail address on the web servers you access.
  14. Policy Update Without prejudice to the preferential application of specific legal texts to this effect, such as informative texts inserted in data collection forms, as well as, where applicable, in the conditions of particular services, ikanos will periodically update this Privacy Policy and the treatment of personal data of website users. Any modification of this policy will be published in their web sites. In any case it will be the responsibility of the user to periodically access the ikanos Privacy Policy published on the websites, in order to know at all times the latest version.
